Before we talk
What's the difference between a "claims made" policy and an "occurrence" policy?
On a claims made basis, the policy in force on the day the claim is made is the one that responds, subject to the retroactive date. On an occurrence basis, the policy in force on the day the event happened responds, even if the claim is made years later. Most professional liability, D&O and cyber policies are written on a claims made basis.
What is a retroactive date, and why does it matter?
It's the date from which acts or errors are covered. An act that happened before that date won't be covered, even if the claim is made during the policy period. When switching insurers, it's important to keep the original retroactive date.
I'm a director of a small private company. Do I need D&O insurance?
Claims against officers happen in private companies too: from investors, creditors, employees, suppliers or regulators. D&O insurance protects your personal assets, and investors sometimes require it before a funding round.
I work carefully. Why do I need professional liability insurance?
Even careful work can lead to a claim, and even an unfounded claim costs money to defend. The policy covers legal defense costs and compensation, if liability is established.
Does cyber insurance cover a ransomware attack?
Most cyber policies include incident response costs: investigation, system restoration, legal advice and loss of income during downtime. Cover for the ransom payment itself depends on the policy terms and the law.
